Acceptance of Terms

By accessing or using the services provided by Xperience Medellín ("we," "us," or "our"), including booking tours through our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our services.


These Terms constitute a legally binding agreement between you and Xperience Medellín. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes acceptance of the updated Terms.


By using our services, you confirm that you are at least 18 years of age or have the consent of a parent or legal guardian, and that you have the legal capacity to enter into this agreement.

Booking and Payment Terms

Booking Process


All tour bookings are subject to availability. A booking is confirmed only after successful payment processing. We reserve the right to refuse any booking at our discretion.


Payment


Payment is required at the time of booking. We accept the following payment methods:


  • Bold CO (for Colombian customers): credit/debit cards, PSE, Nequi, and Bancolombia button
  • PayPal (for international customers): credit/debit cards and PayPal balance

  • All prices are quoted in either Colombian Pesos (COP) or US Dollars (USD) depending on the selected payment method. Prices include applicable taxes as disclosed at checkout.


    Price Accuracy


    While we strive to ensure all prices are accurate, errors may occasionally occur. If we discover a pricing error after you have placed a booking, we will inform you as soon as possible and offer you the option to reconfirm your booking at the correct price or cancel and receive a full refund.


    Group Bookings


    For group bookings of 10 or more participants, please contact us directly for special arrangements and pricing.

    Cancellation and Refund Policy

    Cancellation by You


    Cancellations must be made at least 48 hours before the scheduled tour departure time to receive a full refund. Cancellations made within 48 hours of the tour are non-refundable.


  • More than 48 hours notice: Full refund to original payment method
  • Less than 48 hours notice: No refund
  • No-show: No refund

  • To cancel a booking, please contact us via email or WhatsApp with your confirmation number.


    Cancellation by Us


    We reserve the right to cancel any tour due to:

  • Insufficient participant numbers (minimum group size not met)
  • Severe weather conditions that pose a safety risk
  • Force majeure events (natural disasters, civil unrest, government restrictions)
  • Operator illness or emergency

  • In the event we cancel a tour, you will receive a full refund or the option to reschedule at no additional cost.


    Rescheduling


    You may request to reschedule your booking up to 48 hours before the tour departure at no charge, subject to availability. Rescheduling requests made less than 48 hours before departure may incur a rescheduling fee.

    User Responsibilities

    Accurate Information


    Users must provide accurate and complete information when making a booking, including correct contact details, participant count, and any relevant health or medical information that may affect participation in the tour.


    Conduct


    You agree to:

  • Follow all instructions and safety guidelines provided by our tour guides
  • Treat other participants, guides, and third parties with respect
  • Refrain from behavior that endangers yourself or others
  • Comply with all applicable local laws and regulations during the tour
  • Not be under the influence of alcohol or illegal substances during the tour

  • Health and Fitness


    Some tours require a reasonable level of physical fitness. You are responsible for assessing whether a tour is appropriate for your physical condition. Please inform us of any medical conditions, disabilities, or dietary restrictions at the time of booking.


    Personal Belongings


    You are responsible for your personal belongings during all tours. We recommend leaving valuables at your accommodation.


    Minors


    Participants under 18 years of age must be accompanied by a parent or legal guardian who agrees to these Terms on their behalf.

    Limitation of Liability

    Assumption of Risk


    Participation in tours involves inherent risks, including but not limited to physical injury, illness, loss of personal property, and exposure to local conditions. By booking a tour, you acknowledge and accept these risks.


    Our Liability


    To the maximum extent permitted by Colombian law, Xperience Medellín shall not be liable for:


  • Any indirect, incidental, special, or consequential damages
  • Loss of enjoyment, loss of revenue, or economic loss
  • Injury, illness, death, or property damage arising from tour participation, except where caused by our gross negligence or willful misconduct
  • Circumstances beyond our reasonable control, including weather events, natural disasters, strikes, civil unrest, government actions, or epidemics

  • Maximum Liability


    Our total liability to you for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific tour giving rise to the claim.


    Indemnification


    You agree to indemnify and hold harmless Xperience Medellín, its officers, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or your negligent or wrongful conduct during a tour.

    Governing Law

    Applicable Law


    These Terms of Service are governed by and construed in accordance with the laws of the Republic of Colombia, including Colombian Law 1480 of 2011 (Estatuto del Consumidor — Consumer Protection Statute), which establishes the rights and obligations of consumers and suppliers of goods and services in Colombia.


    Consumer Rights


    As a consumer, you are entitled to the protections afforded by Colombian consumer protection law, including but not limited to:

  • The right to receive accurate information about services
  • The right to a refund for defective services
  • The right to file complaints with the Superintendencia de Industria y Comercio (SIC)

  • Dispute Resolution


    In the event of a dispute, we encourage you to contact us first to attempt an amicable resolution. If a resolution cannot be reached, disputes shall be subject to the jurisdiction of the competent courts of Medellín, Colombia.


    Severability


    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


    Entire Agreement


    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Xperience Medellín regarding your use of our services and supersede all prior agreements and understandings.
